(Software, SaaS, Government and Law‑Enforcement Use)

1. Acceptance of Terms
These Terms of Service
(“Terms”) govern access to and use of the software, platforms, applications,
websites, and services (collectively, the “Services”) provided by Nexus
Command Systems, LLC (“Nexus,” “we,” “our,” or “us”).
By accessing or using the
Services, you agree to be bound by these Terms on behalf of yourself and, if
applicable, the agency or organization you represent. If you do not agree, do
not use the Services.
2. Intended Use and
Authorized Users
Nexus Command Systems
provides software‑as‑a‑service (SaaS) and operational support tools
intended for:
- Law‑enforcement agencies
- Public safety entities
- Government organizations
- Authorized civilian partners and administrators
Use is restricted to official,
lawful, and authorized purposes only. Unauthorized access or use is
strictly prohibited.
3. Accounts and Agency
Responsibility
If Services require
account access:
- Agencies are responsible for authorizing and managing users
- Users must safeguard credentials
- Agencies are responsible for actions taken by their authorized
users
Nexus assumes no
responsibility for misuse caused by improper account management at the agency
level.
4. Software and
Service Availability
Services are provided on
an “as available” basis. While Nexus is designed to support operational
environments, Services are not a substitute for officer judgment, training,
supervision, or established policies.
Nexus does not
guarantee uninterrupted availability, real‑time accuracy, or suitability
for mission‑critical or life‑safety decisions.
5. Data Ownership and
Use
- Agencies retain ownership of data they input
- Nexus may store, process, and transmit data solely to provide
Services
- Nexus may use anonymized, aggregated data for system
performance, analytics, and improvement
Nexus does not claim
ownership of agency operational data.
6. CJIS and Sensitive
Information
Where applicable, Nexus
maintains administrative and technical safeguards designed to support law‑enforcement
data security.
However:
- Nexus does not certify CJIS compliance unless explicitly stated
in a separate written agreement
- Agencies remain responsible for ensuring their use complies
with CJIS, state, and federal regulations
7. Prohibited Use
You may not:
- Use Services for unlawful surveillance or civil rights
violations
- Attempt to breach system security
- Reverse engineer or misuse the platform
- Share access outside authorized personnel
Violation may result in
immediate suspension or termination.
8. Intellectual
Property
All software, systems,
interfaces, documentation, trademarks, and logos are the exclusive property of
Nexus Command Systems.
No license is granted
except as necessary to use the Services.
9. Disclaimers
Services are provided “AS
IS” and “AS AVAILABLE.”
Nexus disclaims all warranties, including:
- Fitness for a particular operational outcome
- Error‑free performance
- Real‑time reliability
Operational decisions
remain solely the responsibility of agency personnel.
10. Limitation of
Liability
To the fullest extent
permitted by law, Nexus Command Systems is not liable for:
- Operational decisions
- Officer actions
- System downtime or delays
- Indirect, incidental, or consequential damages
11. Indemnification
Users and agencies agree
to indemnify Nexus Command Systems from claims arising out of misuse,
unauthorized access, or violation of law or policy.
12. Termination
Nexus may suspend or
terminate access for violations, security concerns, or misuse, with or without
notice.
13. Governing Law
These Terms are governed
by the laws of the State of North Carolina, exclusive of conflicts‑of‑law
rules.
